This series of tutorials goes about exploring the portugues civil code which applies to the state of Goa and union territories of Dadra & Nagar Haveli and Daman & Dui.
In such areas , irrespective of religion , person having the do9micile of such places are governed by the portuguese civil code
The portuguese rules over 400 years in such places and finally when they were removed in 1961 and laws subsequently replaced by the indian government , among the laws that still found existence one was the Portuguese Civil code !
Under this code and the section 5A of the indian income tax act 1961 , any income other than salary income from employment has to be shared (apportioned )with the spouse
This civil code is applicable to all persons irrespective of religion and under this code , a person is supposed to file return of income only showing his share of income
The portugues civil code however only to state of Goa , Union territory of Dadra & Nagar Haveli and Daman & Dui.
So , in other any place same is not applicable
So as a mumbai resident , i dont have to share my Capital gain or House property income with my spouse and then show my share of income which i would be doing had i been holding a domicile of goa and was covered under portuguese civil code
Also under the community law property , the spouse holds joint ownership of all the assets that she brings with her marriage and inherit's and so the husband cannot just dispose of the aasets on his own
Good for the spouses , however law is restricted to applicable provinces !
